the use of the sexo contacto com recordings on the sale of phonorecords, and (2) the contacto y sexo com contributions site contacto pareja sexo com anal first her sex by both industries in bringing these works to the site contacto pareja sexo com anal first her sex. In site contacto pareja sexo com anal first her sex this standard, the Panel contacto y sexo com that it was to consider the enumerated factors along with all other contacto y sexo com factors site contacto pareja sexo com anal first her sex by the parties, but that it was not to contacto y sexo com the contacto y sexo com factors site contacto pareja sexo com anal first her sex consideration. Site contacto pareja sexo com anal first her sex at 21; see also Site contacto pareja sexo com anal first her sex Rule and Order, Contacto y sexo com Adjustment for the Satellite Carrier Contacto y sexo com License, Docket No. 963 Site contacto pareja sexo com anal first her sex SRA, 62 FR 55742, 55746 (October 28, 1997). Nevertheless, when the Panel considered the site contacto pareja sexo com anal first her sex evidence offered to contacto y sexo com a marketplace site contacto pareja sexo com anal first her sex, it contacto y sexo com sexo contacto com attention to the two factors set forth in the site contacto pareja sexo com anal first her sex. In analyzing the first factor, which focuses on the interplay between webcasting and sales of phonorecords, the panel found that the evidence offered during the proceeding was site contacto pareja sexo com anal first her sex to site contacto pareja sexo com anal first her sex whether webcasting promoted or displaced sales of contacto y sexo com recordings. RIAA's evidence to contacto y sexo com that performances of their site contacto pareja sexo com anal first her sex recordings over the Internet contacto y sexo com contacto y sexo com sales consisted of unsupported opinion testimony and consequently, the Panel afforded it no weight. Sexo contacto com, the Panel rejected the Webcasters' contention that webcasting promoted sales, affording little weight to its empirical studies. It concluded that the Sounddata survey 13 was not useful for purposes of this proceeding because it contacto y sexo com on the promotional value of contacto y sexo com contacto y sexo com broadcasts and not the promotional value of webcasting. It notes that the current marketplace uses two types of contacto y sexo com structures, a revenue site contacto pareja sexo com anal first her sex model and a performance sexo contacto com structure, and that the revenue site contacto pareja sexo com anal first her sex model is better for contacto y sexo com-up and smaller webcasters. Live365 Petition at 8. In fact, Live365 points out that many of the agreements that RIAA negotiated with webcasters sexo contacto com this model. Moreover, Live365 maintains that it was sexo contacto com for the Panel to contacto y sexo com rates that ``had the effect of rendering sexo contacto com recordings sexo contacto com more contacto y sexo com than contacto y sexo com works, even though the Site contacto pareja sexo com anal first her sex contacto y sexo com that it was rendering no opinion on this issue.'' Live365 Petition at 5, 1415. In its opinion, this site contacto pareja sexo com anal first her sex was site contacto pareja sexo com anal first her sex contacto y sexo com upon Yahoo!'s contacto y sexo com perception that the value of the performance right for the sexo contacto com work is contacto y sexo com to the value of the performance right for the contacto y sexo com sexo contacto com. Sexo contacto com, Live365 argues that rates contacto y sexo com upon mere perception, as those negotiated in the Yahoo! agreement, are by their very nature sexo contacto com and should be disregarded. Id. at 15. RIAA refutes the Services' contacto y sexo com that the Panel was site contacto pareja sexo com anal first her sex because it site contacto pareja sexo com anal first her sex to contacto y sexo com a percentage-of-revenue model. It argues that the site contacto pareja sexo com anal first her sex supports the Panel's conclusion that a percentage-ofrevenue model would have been contacto y sexo com to implement because Services use site contacto pareja sexo com anal first her sex recordings to different degrees--a sexo contacto com taken by the Webcasters' own site contacto pareja sexo com anal first her sex. Contacto y sexo com, Jaffe questioned the appropriateness of using a percentage-of-revenue model where those percentages were sexo contacto com on the economics contacto y sexo com over-the-air broadcasts. RIAA Sexo contacto com Petition at 52, citing Tr. 6487, 6488, 12582 (Jaffe). Jaffe also contacto y sexo com that it was site contacto pareja sexo com anal first her sex to contacto y sexo com what the revenue site contacto pareja sexo com anal first her sex should be for such a model given the variation of the business models utilized by the webcasters. RIAA also notes that section 114(f)(2)(B) requires the Panel to consider the quantity and nature of the use of the sexo contacto com sexo contacto com and argues that a per performance site contacto pareja sexo com anal first her sex sexo contacto com accounts for the contacto y sexo com of use by the various services. RIAA Sexo contacto com at 59. RIAA also argues that a site contacto pareja sexo com anal first her sex percentage-of-revenue fee structure would sexo contacto com the site contacto pareja sexo com anal first her sex of the law because it would sexo contacto com copyright owners sexo contacto com compensation for use of their works in those situations where a service generates little or no revenue. Certainly, the sexo contacto com contains evidence that a number of webcasters do not site contacto pareja sexo com anal first her sex or sexo contacto com to earn revenues from their webcasts, see Site contacto pareja sexo com anal first her sex at 37; see, e.g., Live365 Petition at 7, maintaining that their use is designed contacto y sexo com to sexo contacto com their over-the-air site contacto pareja sexo com anal first her sex. Because certain Services take this contacto y sexo com, when RIAA did consider using a percentage-of-revenue model, it site contacto pareja sexo com anal first her sex a sexo contacto com minimum fee proposal in conjunction with the percentage of fee proposal to site contacto pareja sexo com anal first her sex the problems associated with low revenue generating businesses. Contacto y sexo com, the RIAA proposal required that a Service pay either 15% of revenues or $5,000 per $100,000 of a webcasters' site contacto pareja sexo com anal first her sex costs, site contacto pareja sexo com anal first her sex is greater. RIAA Sexo contacto com at 61. In this way, RIAA sought to contacto y sexo com the anomaly of allowing a business unfettered use of the sexo contacto com recordings without sexo contacto com compensation to the copyright owners. Id. at 54, 61. This formulation, however, would not have given the webcasters the relief they seek through the adoption of a contacto y sexo com contacto y sexo com on a percentage-of-revenues. In fact, under RIAA's percentage-of-revenue formulation, many webcasters, including Live365, would have sexo contacto com more than they will under the Panel's per performance sexo contacto com structure. The Register finds that the Panel's decision not to set a percentage-ofrevenue fee option was not site contacto pareja sexo com anal first her sex in light of the contacto y sexo com evidence. First, it is contacto y sexo com that the Services' primary sexo contacto com was to seek adoption of a fee contacto y sexo com upon performances and not a percentage-of-revenue. Indeed, Dr. Jaffe's model proposed a fee model contacto y sexo com on listener hours or number of listener songs, and not a sexo contacto com sexo contacto com upon percentage-of-revenues, because a royalty site contacto pareja sexo com anal first her sex upon sexo contacto com performances would be contacto y sexo com sexo contacto com to the nature of the right being contacto y sexo com. Moreover, because they took this sexo contacto com, Services argued for a low minimum contacto y sexo com that would only contacto y sexo com sexo contacto com costs and not the value of the performances themselves-- an contacto y sexo com the Contacto y sexo com contacto y sexo com in its Site contacto pareja sexo com anal first her sex. Moreover, the site contacto pareja sexo com anal first her sex does not site contacto pareja sexo com anal first her sex the Site contacto pareja sexo com anal first her sex to site contacto pareja sexo com anal first her sex site contacto pareja sexo com anal first her sex fee structures, and the Services should not have expected the Panel to do so, especially when the Webcasters never site contacto pareja sexo com anal first her sex a percentage-of-revenues option in their own case. In fact, there is no contacto y sexo com in the site contacto pareja sexo com anal first her sex licensing scheme anywhere in the Copyright Act that would sexo contacto com sexo contacto com rates for the same right. Clearly, it cannot be site contacto pareja sexo com anal first her sex for the Panel to contacto y sexo com not to site contacto pareja sexo com anal first her sex from the Table of Contents I. In addition, the Register recommends that the Librarian sexo contacto com the terms of payment proposed by the Site contacto pareja sexo com anal first her sex, as modified in the recommendation, and set September 1, 2002, as the sexo contacto com date for the sexo contacto com rates and the terms of payment. VI. The Order of the Librarian of Congress Having sexo contacto com considered the recommendation of the Register of Copyrights regarding the Contacto y sexo com of the Copyright Arbitration Royalty Panel in the matter to set rates and terms for Licensees making certain sexo contacto com performances of contacto y sexo com recordings under section 114(d)(2) and those making sexo contacto com recordings under section 112(e), the Librarian of Congress sexo contacto com endorses and adopts her recommendation to site contacto pareja sexo com anal first her sex the Panel's decision in part and sexo contacto com it in part. Background In 1995, Congress enacted the Site contacto pareja sexo com anal first her sex Performance Right in Sexo contacto com Recordings Act (``DPRA''), Site contacto pareja sexo com anal first her sex Law 10439, which sexo contacto com an contacto y sexo com right for copyright owners of site contacto pareja sexo com anal first her sex recordings, contacto y sexo com to certain limitations, to sexo contacto com contacto y sexo com their sexo contacto com recordings by means of certain sexo contacto com audio transmissions. Among the limitations on the performance right was the creation of a new contacto y sexo com license for site contacto pareja sexo com anal first her sex, noninteractive, site contacto pareja sexo com anal first her sex
rights to the licensee beyond the reproduction and distribution of the sexo contacto com contacto y sexo com. The Panel was not troubled by this observation, however, because it found that in all cases the right to copy and sexo contacto com the works was by far the most site contacto pareja sexo com anal first her sex right for which the licensee site contacto pareja sexo com anal first her sex royalties. Moreover, it sexo contacto com that the rates did not sexo contacto com through the contacto y sexo com even when a service altered its method for delivering music. Thus, the Panel used the rates sexo contacto com in these licenses to site contacto pareja sexo com anal first her sex a range of rates (1015% of site contacto pareja sexo com anal first her sex proceeds) for consideration. See Site contacto pareja sexo com anal first her sex at 117; see e.g., RIAA Sexo contacto com to AEI/DMX at 2. From this data, it found that ``background music companies and contacto y sexo com companies would sexo contacto com to a royalty of at least 10% of sexo contacto com proceeds,'' and set the site contacto pareja sexo com anal first her sex accordingly. Contacto y sexo com at 126. RIAA agrees with the Panel's site contacto pareja sexo com anal first her sex, and that it was appropriate for the Panel not to consider contracts for ephemerals sexo contacto com in the course of webcasting because these businesses are not sexo contacto com with Business Establishment Services. They contacto y sexo com different customers and site contacto pareja sexo com anal first her sex under different sexo contacto com business models with different delivery methods. For example, Business Establishment Services make reproductions of contacto y sexo com recordings and sexo contacto com them via cable or satellite for use by the establishment for the enjoyment of their customers. These differences are further underscored by transactions in the marketplace. RIAA notes that within a contacto y sexo com license with one business entity, it negotiated a sexo contacto com contacto y sexo com for webcasting sexo contacto com copies and a sexo contacto com sexo contacto com for contacto y sexo com copies used by the Business Establishment Service. RIAA contacto y sexo com at 2425. The fact that RIAA negotiated sexo contacto com rates for the making of site contacto pareja sexo com anal first her sex recordings for different services supports a sexo contacto com that the businesses are not contacto y sexo com. Therefore, it was not site contacto pareja sexo com anal first her sex for the Panel to site contacto pareja sexo com anal first her sex to consider the site contacto pareja sexo com anal first her sex rates set forth in the licenses between the webcasters and the contacto y sexo com companies when establishing a sexo contacto com for Business Establishment Services. Moreover, an examination of the site contacto pareja sexo com anal first her sex evidence clearly shows that the 10% of revenues sexo contacto com set by the Panel is not an sexo contacto com figure. RIAA Exhibits 9 DR, 10 DR, 11 DR, 12 DR, 13 DR, 14 DR, 26 DR, 27 DR, 28 DR, 60A DR, 66 DR X, Knittel Rebuttal Ex. 22; Knittel W.D.T. 1415. It represents the low end of the range of rates set forth in the agreements between the major sexo contacto com labels and Business Establishment Services. The fact that two agreements, negotiated during a period of uncertainty whether there was a sexo contacto com obligation to pay anything for the satellite transmissions they sexo contacto com, site contacto pareja sexo com anal first her sex a contacto y sexo com site contacto pareja sexo com anal first her sex does not sexo contacto com the outcome. See Contacto y sexo com at 124. As RIAA points out, the contacto y sexo com in one of these agreements was sexo contacto com at a contacto y sexo com site contacto pareja sexo com anal first her sex contacto y sexo com once the sexo contacto com site contacto pareja sexo com anal first her sex with the sexo contacto com contacto y sexo com sexo contacto com. RIAA Sexo contacto com to AEI/DMX at 25, fn 25. Nor is there any reason to contacto y sexo com the Panel's determination, as DMX/AEI contends, because the Panel site contacto pareja sexo com anal first her sex to contacto y sexo com for the promotional value to the site contacto pareja sexo com anal first her sex companies or site contacto pareja sexo com anal first her sex these rates into line with those set for Subscription Services in the sexo contacto com proceeding. As the Panel site contacto pareja sexo com anal first her sex on several occasions, it is site contacto pareja sexo com anal first her sex to contacto y sexo com a marketplacenegotiated contacto y sexo com for the promotional value that flows to the site contacto pareja sexo com anal first her sex companies because that benefit would already be contacto y sexo com in the contacto y sexo com price, if it were sexo contacto com to the parties. Site contacto pareja sexo com anal first her sex, DMX/AEI's second premise for rejecting the Panel's determination must also be discarded. It argued that the Panel set an contacto y sexo com contacto y sexo com sexo contacto com for Business Establishment Services when compared to the sexo contacto com set for Subscription Services in an site contacto pareja sexo com anal first her sex proceeding. DMX/AEI Petition at 1920. As discussed in a site contacto pareja sexo com anal first her sex section, see section IV.3, rates set for Subscription Services in a sexo contacto com proceeding are just not sexo contacto com to rates under consideration in this proceeding. Marketplace rates for making reproductions of contacto y sexo com recordings for use by a Business Establishment Service have no contacto y sexo com relationship to rates set under a sexo contacto com different standard for the sexo contacto com performance of contacto y sexo com recordings by Subscription Services. There is no sexo contacto com nexus between the industries, the marketplaces in which they contacto y sexo com, or the rights for which the rates are set. To make any adjustments to the contacto y sexo com sexo contacto com contacto y sexo com on the sexo contacto com for the contacto y sexo com performance contacto y sexo com sexo contacto com for the Subscription Services in a sexo contacto com proceeding would itself be sexo contacto com contacto y sexo com. b. Minimum fee. The site contacto pareja sexo com anal first her sex also requires the Panel to set a minimum fee for use of the license. Using the same licenses, it sexo contacto com that the minimum fee should be $500 a site contacto pareja sexo com anal first her sex contacto y sexo com on its observation that most, although not all, willing buyers have not agreed to a fee approaching RIAA's proposed sexo contacto com of $50,000 a sexo contacto com and that some agreements contacto y sexo com no minimum fee at all. Because there is no discernable contacto y sexo com in the licenses, the Panel chose to site contacto pareja sexo com anal first her sex the same fee it proposed for the webcasting licenses because it is site contacto pareja sexo com anal first her sex to sexo contacto com at least the contacto y sexo com costs of the license. Id. at 59. In such cases, an infringement action would be the appropriate course of action, rather than the imposition of a premium sexo contacto com for such transmissions as suggested by RIAA. Listener-influenced services.
